Marinas are continuously required to meet ever-changing demands from many quarters whether this be market forces, environmental regulation or expansion into less protected waters. Around the world different problems inspire various solutions and this presentation will look at several case studies including examples from Monaco, Spain, Italy and New Zealand.

| Topic 2 | Abandoned Vessel Removal
Occasionally marinas are faced with the abandonment of a vessel left at a marina (typically at night) or the failure or refusal of a boat owner to remove the boat following termination of a wharfage contract. Unfortunately, local police officials are often unable or unwilling to assist by removing such boats. It is usually best to attempt to resolve these problems informally (a topic of discussion), but it is not always possible. When a boat occupies a slip or wharf space without contractual or statutory authority (i.e. seeking shelter in a large storm), she becomes a trespasser and may be held accountable by way of the powerful remedy of vessel arrest." Chris will present a case study of how they have been removing abandon/lien sale boats from our harbor in cooperation with the Contra Costa County Sheriff's Department and the Household Hazardous Waste Program.

| Topic 3 | TMDL's: Targeting Marinas Dirty Little Secret or Why the Paint Police are Often Called "Cops"
No good deed goes unpunished. Several years ago, scientists discovered that anti-fouling paints containing Tributyltin (TBT) were harmful to marine life. The use of TBT was banned and the coatings industry shifted to safer alternatives. Now, these copper-based alternatives are also coming under fire despite the fact that they were registered and approved by the EPA. State authorities are proposing to regulate the use of copper-based hull paints by making marina owner/operators responsible for the resulting water quality in their facilities. In some cases, regulators are suggesting that marinas may need a federal wastewater discharge permit similar to those issued to municipal sewage treatment plants. Violations of the Clean Water Act can result in fines of up to $25,000/day and subject marinas to expensive civil litigation from environmental interest groups. The final cost of compliance may reach into the millions. This workshop will discuss, in detail, how to develop a coherent management strategy when the state and federal regulators focus their attention on your marina. The presenters will relate their real-world experiences coping with the recently adopted TMDL requirements to reduce copper concentrations in the Shelter Island Yacht Basin of San Diego Bay.

| Topic 1 | Grow Boating Update
Boating industry growth depends on attracting new boaters, retaining current boaters, providing better product, providing a more professional sales and service experience and maintaining and growing quality access to water. The industry's Grow Boating Initiative is focused on each of these areas. NMMA President Thom Dammrich will discuss the Grow Boating Initiative and what the industry is doing to improve the consumer experience in each of these areas.

| Topic 2 | Marina 101 - Marina Electrical Safety
A presentation to help marina personnel recognize some of the more common hazards associated with providing AC shore power to moored boats. Because electricity goes about its task of providing services and comfort, quietly and unobserved, symptoms of a serious potential problem might not be recognized until too late to prevent an accident. This is a brief overview of the main causes of electric shock injury and how to recognize potential problems. Relevant sections of the Marina Electrical Safety Standard, NFPA-303-2006, will be explained. What to do about customer complaints related to under water metal damage will also be addressed. Improvement of electrical safety in the marina is the goal.

We will discuss the pros and cons of HSA accounts, partial self-funding, as well as the traditional PPO and HMO plans most of us have used in the past. The availability of guaranteed issue plans will also be reviewed for those with employees that may have health issues that have created problems in obtaining coverage in the past.

Overview of the basic elements of emergency preparedness, with emphasis on practical solutions in anticipation of major events such as fire, earthquake and severe weather. Additional information presented will aid in the formulation of proper response, utilization of assets, development of formalized protocol, and presentation of substantive training. Information will be submitted for the development of response plans, or for developing a more formalized version of existing guidelines. In August of 2006, the State Water Board was finally able to release the Marina Fueling Facility Project Report. The project was a statewide study to evaluate the status of MFFs on California's coastal and inland waterbodies. The resulting Marina Fueling Facility Project Report details the results of the inspections and recommendations install fully-double walled systems; using continuous electronic leak detection in the interstitial space, having an independent testing organization approve piping used in above ground applications, using anti-siphon devices, having an emergency shut-off device, and regulating MFF ASTs and USTs under the same requirements.

The options discussed will include management and employee training procedures, rental contract language, warnings, equipment and renter checklists, and insurance coverage for both the operator and the renter. Rental boat operators are cordially invited to bring their own contracts, checklists and other documentation to share with the presenters and attendees.
