8:30 AM  SWRCB Permit

Randy
Short

Josh
Burnam
State Water Resources Control Board "Statewide Marina Permit", as presented to the industry is the biggest threat to the economic viability of salt water marinas that I have seen in my history in the industry. This is a program that we must not allow to go forward, that is being crafted in a vacuum by a staffer with no knowledge of our industry and no care for how it impacts us as operators. As she said in response to Bill Krauss' question as to why this was being done "it has to be done and the State can't afford to do it". This is government at its worst level of abuse; you won't want to miss this overview.

1:30 PM  Four topics to choose from:
Topic 1:  How to Deal with Seasonal Business and Seasonal Retail Stores

Kathy
Gianatasio
This session will include partnerships with vendors and suppliers, focus on at least one new mission that creates a new profit center, and the importance of education and participation of minimum one employee from each division.
Kathy Gianatasio, Manager of Business Development, Diversified Marine Products

Kathy Gianatasio
Diversified Marine Products

Most of my career has been in distribution of marine accessories beginning in January
1974. For 10 of those years, I also held ownership in a retail accessory store in a
waterfront marina. After spending 25 years in the field as an outside sales rep, my
position expanded to sales management of all States west of the Rockies, including Alaska,
Hawaii, and Mexico. In 2006 Diversified was acquired by Brunswick Boating Group Division
and expanded our inventory to include Mercury/Quicksilver engine parts, oils, lubes, and
Mercruiser engines (new and re-man). Most recently we have turned our attention and
inventory commitment towards marinas, boat yards, repair shops and haul-outs. My
current position with Diversified Marine Products is manager of Business Development.
I have always been especially interested in inventory management and turns from a retail
point of view. If the product just sits on the shelf and doesn't move through to the
end user, nobody wins.

Itinerary includes partnership with vendors/suppliers, focus on at least one new
mission for marina that creates new profit center, and importance of education and
participation of minimum one employee from each division. Yes, including the fuel dock.
Topic 2:  Pass the Ammunition: How to Load Up Your Marketing Guns and Make an Impact

Robert
Wilkes
We all have a fairly good understanding of marketing, what it does and how it does it. What is less well understood are the underlying concepts that make one marketing program successful and another go unnoticed. Mr. Wilkes will guide you through a survey of basic marketing strategy and communication techniques. The objective of the seminar is to gain a deeper understanding of how to apply these techniques and capitalize on their power to move a business or organization to the next level.

Topic 2:  Marina Fuel & Petroleum Piping: Challenges and Options in Today's World

We all know that the goal for marina fuel and petroleum piping is to have a safe and non-leaking system that can withstand the environment over the life expectancy of the systems. The "green sheen" on the water is not acceptable in today's world. In the marina environment we must deal with dramatic temperature swings, constant exposure to water and dampness, salt water corrosion, tidal actions, customer abuse of equipment, wind, sun/ultra-violent light exposure, vibration, bird feces corrosion, etc. Increasing environmental regulations are requiring new designs that can better tolerate these conditions and also offer double wall protection, leak detection, spill prevention, and auto-shutdown features. At the same time these increased regulations are being implemented, marina owners and operators are under increasing financial pressure to keep costs down while maintaining the safety of the environment. The discussion will focus on what works, what does not work, choices of materials, and options for design.

Topic 3:  Secured Maritime Claims of Marinas – Strategies for Dealing With a Yacht Owner’s Bankruptcy

Philip E.
Weiss
The troubled economy has led recently to a record number of people, including boat owners, seeking the protection of Bankruptcy Courts. When a yacht owner “declares bankruptcy,” the objective of the debtor is usually to discharge all debts, without paying any of the balance due. What such boat owners, and even bankruptcy judges and lawyers often do not know, is that those who provide wharfage and other maritime services are not general creditors – they are secured creditors who “own” a part of the vessel. What should a marina owner or operator do when a person who files for bankruptcy maintains a vessel at its marina? It is necessary to retain an attorney? What if the vessel at issue is encumbered by not only a marina’s lien but also by a lender’s Preferred Ship Mortgage? How should any fees that accrue after the filing of bankruptcy be handled? The marina’s strategy in such circumstances will depend on precisely the circumstances presented, including, if a Preferred Ship Mortgage is involved and the lender’s level of sophistication. Please join us in exploring these timely issues.

service in the U.S. Navy, Weiss earned a Juris Doctorate from the University of San
Francisco, where he served as Editor-in-Chief of the U.S.F. Maritime Law Journal, a
leading academic periodical. Weiss is a respected author and speaker on maritime law
issues, and has, for 16 of his 19 years of practice, successfully represented hundreds
of marina, boatyard and other clients in a broad array of maritime issues, including
those involving "necessaries" liens, trespassing/abandoned vessels, vessel arrests,
wharfage and other maritime contracts, oil pollution, allisions/other maritime torts,
and negotiations with holders of competing liens. For the past decade Mr. Weiss has
served (and he currently serves) as an Adjunct Professor of Maritime Law at the Thomas
Jefferson School of Law, where he teaches a "survey" class. He is also a non-voting
member of the San Diego Harbor Safety Committee. Mr. Weiss currently sits by appointment
of the California Bar Association as the Vice Chairman of the Commission on Specialization
of Admiralty and Maritime Law, which has established standards for formal certification
of attorneys practicing in this area of the law. He will assume the position of Chairman

Nineteen years ago, in 1990, Shaun McMahon took the helm, as General Manager at
Shelter Cove Marina in San Diego's America's Cup Harbor. Shelter Cove has been
thriving ever since as one of the most sought after marinas around. Shaun's
background is in accounting and finance, having completed her undergraduate work
at SDSU and obtaining her MBA from the University of Phoenix. While at SDSU, she
served as president of the alumni's Women in Business Association.

While working in the marina industry, Shaun has involved herself with several
committees and organizations focusing on issues of environmental pollution and
regulations that affect the recreational boating community. From 1998-2000, she
served on the San Diego Oceans Foundations Board. Currently, Shaun is spending a
great deal of her extracurricular time as the San Diego Regional Certification and
Review Coordinator for the California Clean Marinas program. Thanks to Shaun and
her colleagues at the CMC program, more than 80 marinas in the state have been
certified and marinas are calling daily to schedule reviews. This program is vital
to the protection of the natural environment necessary for a healthy recreational
boating industry. The program is completely voluntary, and plays an integral role
in avoiding costly, cumbersome regulation that might otherwise prove to be a
stranglehold on this industry.

Shaun has also ably served on the Marina Recreation Association Board of Directors
for the last seven years and is currently Treasurer. When she isn't juggling all
of these professional responsibilities, she is a devoted and doting mom, residing
in Chula Vista with her six-year-old, Ryan.
