with marine and boating industry regulators and California state legislators.

In October 2020, Governor Newsom issued Executive Order

N-82-20, advancing biodiversity conservation as an administration priority, and elevating the role of nature in the fight against climate change. As part of this Executive Order,

California committed to the goal of conserving 30% of our lands and coastal waters by 2030 (the “30x30” initiative). In 2022, the California Natural Resources Agency (CNRA) released Pathways to 30x30; Accelerating Conservation of California’s Nature, detailing strategies and opportunities for achieving the 30x30 target.

Jenn Eckerle, Deputy Secretary for Oceans & Coastal Policy at the CNRA, and Executive Director of the Ocean Protection Council (OPC) will outline the state’s approach to conserving 30% of coastal waters in her presentation “Achieving 30x30 in California’s Coastal Waters” at 10:15 am, April 12th.

Ms. Eckerle serves as a key advisor to the Governor and the Secretary for Natural Resources, and directs policy, scientific research and critical partnerships to increased

protection of California’s coast and ocean. Prior to joining OPC in 2016, Jenn spent eight years as an Ocean Policy Analyst for the Natural Resources Defense Council after serving as a Coastal Program Analyst for the California Coastal Commission and the San Francisco Bay Conservation and Development Commission. She earned an MS in Marine Biology from the Florida Institute of Technology and a BS in Biology from the University of Vermont.

Following Jenn Eckerle at 11:30, Mike Conroy, West Coast Director, Responsible Offshore Development Alliance (RODA), will present a session on “The Status of Offshore Wind Development” delving into the potential impacts to sea and land environments and marina and boating operations.

The United States Coast Guard (USGC) requires boaters to carry several unexpired visual distress signals on board, day and night. Pyrotechnic marine flares are a common type of distress signal, but they are explosive hazardous waste and contain toxic chemicals, like perchlorate, that pose human health risks. Marine flares only work once and expire 36 to 42 months after the manufacture date.

For safety and environmental reasons, it is essential to manage single-use pyrotechnic marine flares carefully. Residents should never throw flares overboard into the environment or out in household trash. However, California resident boaters do not have access to an ongoing expired marine flare disposal program, and recreational vessels generate about 174,000 pyrotechnic marine flares every year, according to the California Expired Marine Flare Working Group as estimated in 2012.

In the absence of safe disposal options locally, the partners encourage resident boaters to consider an electronic visual distress signal device (eVDSD) as a reusable distress signal alternative to the single-use pyrotechnic marine flare.

    SHARE YOUR FEEDBACK ON

    Marine Protected Area Management Priorities

    Deadline is July 7th!

OPC, the California Fish and Game Commission (Commission),

and the California Department of Fish and Wildlife (CDFW) are seeking your feedback on a draft prioritized list of the 28 adaptive management recommendations included in the Decadal Management Review (Review) of California’s Marine Protected Area (MPA) Network and Management Program.

At the request of the Commission, CDFW drafted the priority list after considering all public comment received after the early 2023 release of the Review. Hundreds of comments were received from a diversity of entities and individuals, including tribes, government agencies, NGOs, the fishing community, MPA researchers, and members of the public.

While all the recommendations in the Review are important, CDFW prioritized the list based on identified need, expected timeframe, input received, and level of information and resources available to advance the recommendations. Prioritizing the recommendations will help CDFW, the Commission, OPC, California Native American tribes, and partners focus efforts to achieve near-term, mid-term, and long-term priorities.

The Commission asks for your feedback on the draft prioritized list to inform the July 20, 2023 meeting of the Commission’s Marine Resources Committee. For your written comments to be included in the July meeting materials, they must be submitted to the Commission by 5:00 p.m. on July 7. Visit the Commission website for instructions on submitting written comment and upcoming meeting information. The public is also welcome to join the meeting virtually or in person to provide public comment verbally.

Boat Rental Exposures and Best Practices Highlighted at this year’s 49th Annual MRA Educational Conference & Trade Show
    ___________________________________________
With the boat rental business expanding at a staggering rate last year and future expansion likely continuing next year, marina operators and insurance companies are taking a close look at ways to reduce liability and operational exposures, while providing a safe and fun boating experience.

Boat renters are typically less experienced than boat owners and occasionally create some less-than-desirable boating situations and outcomes.

This year’s Annual MRA Educational Conference & Trade Show, will feature a special breakout seminar session “Boat Rental Best Practices” on Tuesday October 12th at 2 PM to provide boat rental operators with some suggested policies and best business practices for creating and maintaining a well-run boat rental business.

Otis Felder of Wilson Elser, LLC and Barbara Galgiani of LP Insurance Services, LLC will lead the seminar discussion focused on what boat rental operators can do to better provide a safe and sound rental environment for themselves and their customers. Both Otis and Barbara have extensive knowledge and experience working with boat rental operations providing insurance coverage and legal defense for claims against rental operators. There will also be a review of a new boat rental document, including a guide for boat rental operators to consider, now being created by a working group of MRA Members from boat rental facilities across the west. The discussion will also cover the importance of contract language and structure of boat rental contracts.

The 2021 Annual MRA Educational Conference & Trade Show in partnership with the California Association of Harbor Masters & Port Captains, will bring together two pivotal marine industry organizations with an expanded theme and focus. In addition to a broad range of educational seminars focused on both inland and coastal marina operations the Conference will also feature an extensive Trade Show exhibiting the latest technology and engineering in marine products and services from leading industry vendors and contractors focused on innovation, growth, and profitability to meet today’s evolving industry needs.

For a complete description of ALL Conference events and seminars, scheduled for October 11 – 13, and to registration for the 49th Annual MRA Educational Conference & Trade Show, in partnership with CAHMPC, visit the MRA website at www.marina.org OR the CAHMPC website at www.harbormaster.org

1st of three FREE MRA Educational Series Interactive Webinars now Available on MRA Website

The Marine Recreation Association’s first (of many) Educational Series, ZOOM webinars was a resounding success with critical information for the marine industry and enthusiastic participation.

Webinar #1, presented by Robert Newsome, Senior Vice President of Operations for the National Marine Manufacturers Association, covered the Economic Impact of the Marine Industry and Boating in California and took place via ZOOM webinar on October 6th.

“Robert’s presentations are very informative and helpful to determine the economic impact of boating in local markets,” Said Stephan Popescu, Los Angeles County Dept. of Beaches and Harbors. “He presents the market data and analysis in a way that is very easy to understand, broken down by different market sectors. He is a pleasure to listen to and always informative.”

Kate Pearson, Safe Harbor Marinas added, “this first seminar included high quality content, and Robert and the NMMA team presented user-friendly market statistics and forecasts; a must see for marina owners and operators. The MRA is presenting some terrific educational opportunities, and I am very excited about the rest of the coming seminars”

MRA Members and others who were not able to attend the live webinar may review the video and PowerPoint presentation Economic Impact of the Marine Industry and Boating in California on the MRA website at www.marina.org.

The 2nd FREE MRA Educational Series webinar will be presented on October 21st at 11 AM by Shelly Anghera, PhD and Principal Scientist at Moffat & Nichol, who will lead a discussion focused on Navigating NEW Copper Paint Regulations and Charting a Course of Survival for the Marina Owner / Operator in response to new Copper Antifouling Paint (AFP) controls being prioritized in the Nonpoint Source Implementation developed by the California State Water Resources Control Board . . . something all marina owners and operators need to be concerned about!

For more information on this critical marine industry topic and to register for the ZOOM Webinar visit the MRA website at www.marina.org

Pre-registration is required for all of the webinars to receive your ZOOM Meeting Code, and of course, as many staff as desired can participate in each internet session. Registration and other information on all of the MRA Educational Series topics and schedules is being posted on the MRA website at www.marina.org and will be updated regularly.

Election Call To Action Vote No on Prop. 15 see more

Election Call To Action Vote No on Prop. 15

    YOUR IMMEDIATE ATTENTION REQUIRED -
YOUR BUSINESS IS ON THE LINE!

Sacramento, CA - With mail-in ballots arriving and the airwaves filling with messages we are asking for your immediate attention to Proposition 15 - The Split Roll Tax.

Split Roll is just that in simple terms. It splits commercial property taxation from the residential protections provided by Prop. 13. As if the pandemic and California's tax and regulatory environment were not difficult enough, this proposition, should it pass, would be devastating.

MRA exists to educate, inform, and protect our members. Our roll here given our limited resources is to ask you not only to vote NO on prop 15, but make it a priority to spread the word to your patrons, vendors, friends and family - all those that rely on a healthy marina industry for their wellbeing.

This is the single most important legislative issue for marina owners in many years. The additional cost to marina owners would be crippling.

See details on how Prop 15 Impacts Marina Owners Specifically Below.

What can you do to help defeat Prop 15?

    *Vote no
*Ask your friends and family to vote No
*Send this call to action to your customers, vendors, fellow business owners, etc. email contacts right away and ask them to vote no and spread the word.

Take a look at the websites where you can add your voice and make a contribution.

    www.associationofwesternemployers.com/stoptaxes

    https://noonprop15.org/take-action/

This is already slated to be a big money fight, but these battles are won in the trenches and our membership must work together to support the major campaigns on the grassroots level. Propositions are decided by the voters, so spread the word.

HOW WOULD PROP 15 IMPACT MARINA OWNERS SPECIFICALLY?

For many marinas, property taxes are already the largest single operating expense. Depending on when the marina was purchased, this proposition could double (if not more) the largest single expense item, eating up much of the remaining cash flow after debt service.  Municipally owned marinas not under long term lease arrangements might be exempt putting privately owned (or leased) marinas at a tremendous disadvantage.

Two concerns raised about appraising a commercial property on its highest and best use (such as a hotel or multi-family residential) and taking into consideration the value of the possessory interest are implied in the "fair market value" re-appraisal every 3 years.

The Split Roll Ballot Initiative would:
*Create a "split roll" where commercial and industrial properties would be assessed at Fair Market Value (to be determined by the County Appraisers) starting with a phase-in in 2022-23. The exact nature of the phase in would be determined by the legislature. Commercial and industrial properties would then be re-appraised by the appraiser every 3 years.

*Raise taxes to commercial/industrial property owners by $11.5 billion annually.

*Exclude residential, residential rental and some agricultural properties

*Exclude properties with a value under $3 million, but this of course is a very low threshold for commercial properties and specifically marinas.

*Will have the FMV reassessment phased in starting in 2025-26 for properties occupied 50% or more by small businesses. However, the definition of "small business" is so narrow the only buildings that would likely qualify are buildings where the actual owner occupies 50% or more of the property and is a stand-alone California entity (cannot be owned or controlled by another entity) and has 50 or fewer employees. This would not apply to a marina, except perhaps for a small management office occupied by the marina owner.

*Eliminates personal property taxes on the first $500,000 of equipment and any other personal property. This is somewhat of a red herring since taxes on these amounts are minor compared to the real property taxes.

    Thank you,

    Scott Robertson
    MRA President

Three FREE ZOOM Interactive Webinars see more

MRA Educational Series kicks-off in October with Three FREE ZOOM Interactive Webinars

With the cancellation of this year's 49th Annual MRA Educational Conference & Trade Show due to the COVID-19 pandemic, the Marine Recreation Association has developed the new MRA Educational Series, a series of interactive ZOOM webinars focused on marine industry education and information to help our members meet the new and enhanced challenges and potential facing the industry today.

The first of these FREE online ZOOM webinars will kick-off on October 6th at 11 AM with a presentation by Robert Newsome, Senior Vice President of Operations for the National Marine Manufacturers Association, covering the Economic Impact of the Marine Industry and Boating in California. As one of the top boating states in the country, recreational boating creates more than 40,000 jobs in California and contributes over $2 Billion in GDP. This past summer has seen surprising and extraordinary strength and growth in the industry, and this interactive presentation will provide up-to-date statistics and other insight into trends in boating participation, new & used boat sales, and other impacts on the marine industry resulting from the growing passion today for boating and fishing activities.

On October 21st at 11 AM, Shelly Anghera, PhD and Principal Scientist at Moffat & Nichol will lead a discussion focused on Navigating NEW Copper Paint Regulations and Charting a Course of Survival for the Marina Owner / Operator in response to new Copper Antifouling Paint (AFP) controls being prioritized in the Nonpoint Source Implementation developed by the California State Water Resources Control Board. These Plans pose a very real threat to the survival of coastal and inland marinas and boatyards, and this presentation will discuss the range of compliance requirements and related costs that responsible operators and boaters may incur if the proposed controls are fully implemented. Dr. Anghera has more than 20 years of experience conducting studies related to eco-toxicology, and water and sediment quality testing and analysis. She has a unique understanding of the AFP issues, and has worked closely with the MRA and members this past year to present formal comments and arguments to the State Board, and in the development of unique water quality compliance strategies . . . all MRA members should be concerned about this critical regulatory issue.

On November 10th at 11 AM, Beau Biller, MRA Lobbyist with Platinum Advisors, will give all participants an update on pending and recent California Legislation, and Nicole Vasilaros, Senior Vice President, Government & Legal Affairs for the NMMA, will provide National Legislative Update. Above all, in this environment it is critical that we all be aware of new and pending regulations and laws and what we can do to impact those actions.

These first three sessions of the MRA Educational Series will be FREE of charge for all participants. With more than 18 education and training topics planned for presentation through June 2021, the complete MRA Educational Series will provide timely and important insight into key marine industry management, operations, and marketing concerns in a fun, informative, and interactive online format covering a broad range of strategies for enhancing guest services, improving operations, meeting regulatory compliance, maximizing marketing impact, and optimizing fiscal results within the evolving COVID-19 environment.

To help cover expenses and provide continuing services for all members of the MRA, subsequent sessions of the MRA Educational Series will carry a nominal charge depending on the number of seminars to be registered for, as follows:
    *Full Package (includes ALL sessions)
    Member Price $299

    Non-Member Price $399

    *3 Sessions
    Member Price $74

    Non-Member Price $104

    *1 Session
    Member Price $34

    Non-Member Price $54

Pre-registration is required and easy through the MRA website to receive your ZOOM Meeting Code, and of course, as many staff as desired can participate in each internet session. Registration and other information on all of the MRA Educational Series topics and schedules is being posted on the MRA website at www.marina.org and will be updated regularly.
